Judge Sides With Hotel Owner In West Broad Village Case

A federal judge ruled in favor of the Aloft hotel at the West Broad Village development on Wednesday. Aloft’s attorneys filed a complaint with the mixed use center’s developer, Unicorp National Developments of Orlando, Florida, last week. The complaint alleged that Unicorp breached its contract with the hotel by not meeting various obligations and deadlines.

One such obligation dealt with in the ruling was what to do with the space on the hotel’s lower level, which Unicorp was supposed to purchase and lease out. Restaurants and shops were to fill the space. Judge Richard L. Williams had held off making a ruling last week, but today said Aloft may now pursue leasing the bottom floor.

Unicorp allegedly did not have the cash to purchase the property as planned. Aloft now has both the right to lease the space and also to any and all leads Unicorp made on tenants for the property as part of the deal.

Other issues brought up in last week’s complaint were not addressed in today’s ruling. They include unfinished work on both a parking garage and roads adjacent to the hotel building.

Aloft is scheduled to open on August 6, just one day before a permanent injunction hearing on the fate of the lower floor is planned.
