The agenda for the Monday, June 11 City Council meeting (PDF) contains the following (among others):

Ord. No. 2012-85 (Patron: Mayor Jones, By Request) – To authorize the special use of *** 25 and 27 North Belmont Avenue to permit the use of the northern portion of the property as a restaurant ***.

So it looks like Belmont Food Shop will have their day in front of City Council after 7 months of trying.

The ordinance states being voted upon that reason that the special use permit is required is that “the property is located in the R-6 Single Family district, which does not permit commercial uses.” This is somewhat surprising, considering that the rest of the that block is commercial property. The ordinance also says that the building was constructed and configured for commercial use in 1923, and was initially zoned for commercial use, but that subsequent zonings of the property have permitted only residential use since 1943.
