A woman who struck and killed Henrico Police officer Thomas P. Berry, Jr. at the entrance of the John Rolfe Commons shopping center on July 12th has been found guilty of a lesser offense than the reckless driving charge she initially faced.

59-year-old Ann Y. Key, of the 11800 block of Crown Prince Circle, was charged with failing to yield yesterday by a Henrico judge.

The motorcycle operated by Berry, an 8-year Henrico Police veteran, struck the side of Key’s SUV as she turned onto Ridgefield Parkway. Berry was transported to VCU Medical Center where he later died of his injuries.

Key said in court that she looked both ways before turning, but failed to see Berry coming from her left before she turned.

The judge said Key’s actions were not reckless, but simply accidental. She was ordered to pay a $250 fine, plus all court costs.
